1. PHOTOGRAPHER’S WORK
1.1. Discussion and planning of the photoshoot with the Client, including wardrobe styling, location recommendations, and general direction. If a stylist, hair or makeup artist is required, this is an additional service not included in the Photographer’s fee.
1.2. Photographer’s work during the session (taking photos). Photographer may also create candid photos and videos on a smartphone if included in the package. Photographer does not keep or secure Client’s personal belongings during the session.
1.3. Images are edited by the Photographer, including exclusive color correction and retouching of temporary skin defects (e.g. pimples, redness). Permanent features (such as scars, wrinkles, tattoos, hairstyle, or body shape) are not retouched unless explicitly agreed in writing and paid as an additional service.
1.4. Duration of the session depends on the package booked, with a minimum of 1 hour.
2. PRICES AND SERVICES
2.1. Current prices and packages are published on the Photographer’s website.
2.2. Prices include: consultation and planning, shooting time, professional equipment, editing, delivery of final files, and basic archiving.
2.3. Client receives a link to a personal online gallery of edited, high-resolution images. The link will be active for 3 months. Please download and back up your photos.
2.4. The Photographer will archive the photoshoot (edited images only) for 4 months for possible restoration. RAW files are not provided unless otherwise agreed.
2.5. Additional edited images may be purchased for $25 (twenty-five US dollars) per image. Payment is required before delivery.
2.6. If the Client requests extra editing changes, such requests must be made within 5 days of receiving the final photos. Additional editing may incur a fee.
2.7. The Photographer is not responsible for the Client’s belongings (clothes, bags, phones, etc.). An assistant may be hired at the Client’s request ($50/hour, paid by the Client directly).
3. PAYMENT
3.1. To secure a date, the Client must pay a non-refundable booking fee as specified at the time of booking.
3.2. The booking fee is applied toward the final balance. The remaining amount is due on the day of the photoshoot.
3.3. Payments can be made via Zelle, Venmo, cash, PayPal, credit/debit card, or bank transfer. A 5% transaction fee applies to PayPal and credit/debit payments.
3.4. If the Client does not pay the full balance, the Photographer will not deliver the photos.
3.5. If the location requires an entry ticket or photography fee, the Client is responsible for covering this cost (including the Photographer’s ticket/fee).
3.6. Booking fees are non-refundable. If the Photographer cancels the session, all payments will be refunded in full.
4. CANCELLATION
If the Client cancels, the booking fee is non-refundable. If the Photographer cancels, the booking fee and any payments made will be refunded.
5. RESCHEDULING & LATE ARRIVALS
5.1. Sessions may be rescheduled up to 24 hours in advance.
5.2. If the Client is late, the lost time is deducted from the session. The cost remains unchanged.
5.3. If the Photographer is late by more than 10 minutes, the time will be extended accordingly or a partial refund may be provided.
6. STYLE & ARTISTIC RIGHTS
6.1. The Client acknowledges that they have reviewed the Photographer’s work and agrees that the Photographer will deliver in a similar style.
6.2. The Photographer has the final say in the artistic vision and selection of images. RAW files are not provided.
6.3. The Client receives edited photos for unlimited personal and business use (including websites, LinkedIn, Instagram, marketing).
6.4. The Photographer retains copyright and may use selected images for portfolio, website, social media, exhibitions, promotional materials.
7. LIABILITY
7.1. The Client participates in the photoshoot at their own risk. The Photographer is not liable for personal injury, accidents, or property damage during the session.
7.2. The Photographer is not liable for unforeseen technical issues such as equipment failure, data loss, or corrupted files, though all reasonable precautions will be taken.
8. GOVERNING LAW
These Terms are governed by the laws of the State of New York.
